Electric Land is part of the Foundation Property & Capital group. If you hold shares in or have lent money to a group company, that relationship is covered by the Foundation Property & Capital Group privacy notice rather than this one.
In this notice, “personal data”, “processing”, “data controller” and “data processor” have the meanings given to them in the UK GDPR (as incorporated by the Data Protection Act 2018) and, for the German entity, in Regulation (EU) 2016/679.
Please read the following carefully to understand our practices regarding personal data and how we will treat it.

[Placeholder to confirm — see Drafting notes] The Website uses only the cookies strictly necessary to operate it, including to keep you signed in to your account and to remember your language choice. We do not use analytics, profiling or advertising cookies.
We use personal data only for the purposes set out below, and only where we have a lawful basis to do so.

Where we rely on legitimate interests, those interests are in operating and growing our land and energy development business, managing our relationships and protecting our systems. You can object to that processing — see section 10.
We may have obtained your details from publicly available sources, including the Land Registry and the Grundbuch, in order to contact you about land that may be suitable for a project.
We do not make decisions about you by automated means alone.
We will only send you marketing material electronically if you consent. You can opt out at any time, either by using the unsubscribe facility in the material or by emailing info@electricland.com.
We may contact you about land or projects that may be of interest to you using details obtained from publicly available sources. If you have been in contact with us and the relationship then ends, we may keep your details so that we can contact you again if circumstances change and we believe it would be of interest to you. You can ask us to stop at any time.
We may disclose personal data relating to you to third parties in certain circumstances, including:
We may also disclose personal data to third parties where we are under a duty to do so to comply with a legal obligation, to enforce or apply our website terms and other agreements, or to protect the rights, property or safety of Electric Land, our clients or others.
Before we disclose personal data to a third party, we take steps to ensure that the third party will protect it in accordance with applicable privacy laws and in a manner consistent with this notice. Third parties are required to restrict their use of the data to the purpose for which it was provided.
It is our policy to retain documents and information about you, in electronic or paper form, for a minimum of seven years or such longer period as is appropriate — for example, for the life of a lease or option and any limitation period that follows it. The legal basis for this processing is that it is necessary to meet contractual, legal or regulatory obligations. After that, the data may be destroyed or erased without notice to you.
Although the Website only looks to include safe and relevant external links, users should always adopt a policy of caution before clicking any external link on the Site.
The Website, which is maintained by FPC AM Limited, may from time to time contain links to and from the websites of our partner networks. Those websites have their own privacy policies and we do not accept any responsibility or liability for them. Please check those policies before you submit any personal data to those websites.
Communication, engagement and actions taken through external social media platforms, including our LinkedIn page, are subject to the terms and conditions and the privacy policies of those platforms.
The Website may use social sharing buttons, which share content directly from our pages to the platform in question. Where you use such a button you do so at your own discretion, and the platform may track and save your request through your account with it. Those platforms have their own privacy policies and we do not accept any responsibility or liability for them.
Electric Land operates in both the United Kingdom and Germany, so personal data is routinely shared between our UK and German offices and the systems they share.
Personal data we collect may also be transferred to, and stored at, locations outside the United Kingdom and the European Economic Area, and may be processed by staff operating outside those areas who work for us or for one of our service providers — for example when we use IT service providers or data storage services.
Where we transfer personal data out of the UK or the EEA, we do so on the basis of an adequacy decision, or under the standard contractual clauses approved by the European Commission and, for UK transfers, the International Data Transfer Agreement or the UK Addendum. We will take all steps reasonably necessary to ensure that recipients treat your data securely and in accordance with this notice.
We may from time to time expand, reduce or sell parts of our business, including individual sites and the companies that hold them, and this may involve the transfer of certain divisions or of the whole business to other parties. Personal data relating to you will, where it is relevant to any division or asset transferred, be transferred with it, and the new owner or controlling party will, under the terms of this notice, be permitted to use it for the purposes for which it was supplied.
The transmission of information via the internet is not completely secure. Although we will do our best to protect personal data relating to you, we cannot guarantee the security of data transmitted to the Website; any transmission is at your own risk. Once we have received your personal data, we use strict procedures and security features to try to prevent unauthorised access.
We take such steps as are reasonable to store personal data securely, so that it is protected from unauthorised use or access, misuse, loss, modification or unauthorised disclosure. This includes both physical and electronic measures, such as passwords, locked storage cabinets and secured storage rooms. Other measures include:
We take steps to destroy or de-identify personal data when it is no longer required for any purpose for which it may be used or disclosed by us, and we are no longer required by law to retain it.
Data protection law gives you the right to access the personal data we hold about you. To protect your privacy, we may take steps to verify your identity before acting on any request.
We also want to make sure the personal data we hold is accurate and up to date. You may ask us to correct or remove anything you think is inaccurate.
You also have the right, in certain circumstances, to:
Whether you can exercise these rights depends on a number of factors, and in some cases we will not be able to comply with your request — for example where we have legitimate grounds for refusing, or where the right does not apply to the data in question. If you exercise certain of these rights we may be unable to continue to deal with you in the same way, for example where we need the data to comply with a statutory requirement or to perform our obligations to you.
To exercise any of these rights, or if you have questions about our processing, please contact us at info@electricland.com.
If you have a concern about the way we collect or use your personal data, we ask that you raise it with us first. You can also complain to a supervisory authority: in the UK, the Information Commissioner’s Office at ico.org.uk/concerns; in Germany, the Hamburgische Beauftragte für Datenschutz und Informationsfreiheit, or the authority for the federal state where you live or work.
We review and amend this notice from time to time. Any changes will be posted on this page and, where appropriate, notified to you by email. Please check back to see any updates. The new terms may be displayed on-screen and you may be required to read and accept them to continue using the Website.
